Entry in the Register of Agricultural Biogas Producers
The requirement to be registered in the Register of Agricultural Biogas Producers kept by The National Support Centre for Agriculture (KOWR) applies to you if you are an entrepreneur who: intends to carry out a business activity of producing agricultural biogas or electricity from agricultural biogas in renewable energy source installations other than a micro-installation.
To apply for an entry in the Register of Agricultural Biogas Producers an entrepreneur must fulfil all of the following conditions:
- hold a document confirming the legal title to the buildings in which the business activity will be carried out,
- have adequate facilities and installations, including technical equipment, meeting the requirements set out in fire protection regulations, sanitary regulations, and environmental regulations, enabling it to carry out its business activities.
Conduct of business without the required entry in the Register is illegal and constitutes an offence punishable by a restriction of freedom or a fine. Furthermore, according to the RES Act, an entity producing agricultural biogas in a renewable energy source installation or producing electricity from agricultural biogas in a renewable energy source installation other than a micro-installation without an entry in the Register of Agricultural Biogas Producers is subject to a fine of PLN 10 000, administered by the Director General of KOWR.
